IGGA Web Creation/Hosting Services Agreement Web Creation With every Basic Package purchase, Image Group Graphic Advertisement (IGGA) will secure and provide a selected, available domain name on behalf of and in the name of User, for a period of one (1) year. Renewal is the responsibility and at the expense of User. With every Basic Package purchase, IGGA will provide User with six (6) months of Web site hosting. Once the purchase application is submitted, User agrees to complete and submit the Web Site Content Information Form in a timely fashion. User also agrees to submit under the following content submission parameters: CopyReception of all content copy is preferred in a Microsoft 'Word' compatible digital file. If a digital file can not be supplied, User will type or write out all copy for the content of User Web site. Clearly indicate special punctuation and capitalization. Be sure to label each section of User Web site copy with the appropriate button/page name and number. Button Titles have a twenty (20) character maximum with no more than two (2) words. Text files should be supplied in a .doc or .txt format. Photos (Digital / Electronic files are preferred)To ensure proper placement, please label the back of each photo with the following information: 1. The page title and position number ('Services', photo 2). 2. Any descriptive information will help to ensure that IGGA assembles User Web site correctly (e.g. product name, staff member name, etc.). 3. User's name and phone number. Digital Content (GIF or JPEG file format is preferred for ease of cross platform exchange). When supplying content on disk or e-mail, each component (text, graphics, logos, etc.) must be saved as a separate file or attachment, using the following guidelines. Graphic Requirements: Each graphic element (pictures, images, logos, charts, etc.) must be saved separately as a GIF (.gif) or JPEG (.jpg) file. Please remember to include fonts with your artwork, logos, etc. File names should have no more than eight characters and proper extensions (i.e. picture.jpg) for cross-platform compatibility. Camera Ready ArtworkCamera ready artwork includes any color artwork that is crisp and clean. Photostats and Mechanicals are preferred. The following does not qualify as camera ready artwork: faxes, photocopies, printed halftones/tints, pencil sketches, and blue ink print. It is preferred and suggested that finely detailed artwork and small or thin type be supplied on disk instead of hard copy to ensure quality reproductions. IGGA agrees to complete Web site creation within seven (7) days from User completion of content submission. User understands and agrees that they will receive one (1) revision cycle at no charge. Any additional modifications will occur at User's expense and at an hourly rate of $125. Hosting Services Subject to the provisions hereof, the account will be opened upon reception of contract, and repeated in each successive billable period thereafter at the then applicable prevailing rates and charges, unless written notice of cancellation is received from User at least thirty (30) days prior to the beginning of the next billable period. If User gives their credit card number to IGGA, User understands that charges will be billed to User's credit card each month, after the initial six month period, for the basic hosting service at a rate of $60 per six months, unless notice of cancellation is provided at least thirty (30) days prior. User hereby authorizes this automatic billing by IGGA. IGGA's billing cycle is based upon the original account signup date. User hereby agrees to pay any and all attorney fees, court costs, and related expenses incurred by IGGA in the collection of any amount due it. Any account cancellations are effective at the end of that billing cycle. If User is not satisfied and wishes to cancel User's account within 30 days of the day IGGA activates this account, User may do so and receive a full refund of all hosting money paid (@ $10 per month), except for registration fees associated with domain name registration. IGGA may, with 30 days electronic mail notice, change its prices. User agrees to use all IGGA services and facilities at User's own risk. IGGA specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall IGGA be liable for any loss, or loss of data, or any other damages. User agrees to protect and indemnify IGGA against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from User's use of IGGA services. Additionally, User agrees to protect and indemnify IGGA against any and all liability, loss, or expense arising from use of IGGA's service in any manner that is illegal, libelous, or against any IGGA policy. IGGA reserves the right to cancel any account, at any time, without notice, for any reason IGGA considers appropriate. At IGGA's discretion, access to IGGA Web Hosting Accounts may be revoked at any time for abusive conduct on the system and/or the Internet and its resources as a whole. User is solely responsible for usage of IGGA and any statement User makes on IGGA's system may be deemed a 'publication' of the information entered. Acknowledging the foregoing, User specifically agrees not to use IGGA's service in any manner that is illegal, libelous, or against any IGGA policy. The billable service period begins on the date the services indicated in the agreement become available to User. This Agreement shall be governed by and interpreted in accordance with the laws of the State of California, United States of America, and the courts of the judicial district of county of Los Angeles shall have exclusive jurisdiction in respect of any proceeding in connection with this Agreement.
